DEFINITIONS:

"User" means the person or entity using the website. "Owner" means the company that owns the website, Hearns Hobbies "Service Provider" means the company providing the website content management system and hosting services to the Owner for the website. "Website" means "https://www.hearnshobbies.com/"

PRE-SALES/PRE-DISPATCH CREDIT CHECKS:

All orders of large quantities amounting to "$300+ aud or at to our discretion" will be subject to credit checks before finalisation of sales & postage.

PRE-ORDERED ITEMS:

Where there it is a limited edition product, new release or a non stock item we will ask for firm commitment: a deposit or a payment in full. When placing a deposit or pre-ordering an item you are accepting that this is not refundable. In the case we can not confirm the price upfront and the price is substantially different to what was advertised then we will accept to refund the deposit otherwise in any other case the deposit is non refundable.

Pre-order item prices may change upon receipt of products in store. This price may change due to manufacturer request/situations out of our control.

LIABILITY

RESPONSIBILITY

We'll go all out to help you choose the right combination of products for your hobbying needs. And we'll bend over backwards to make sure you're satisfied. But there's a limit to everything. And here's ours:

We cannot accept responsibility for injury and/or crash damage or loss of kits, engines and accessories, parts and materials that occurs during the use of any radio-controlled model. The user shall determine the suitability of the product for his or her intended use and shall assume all risk and liability in connection therewith.

If you substitute or replace normal kit hardware and/or radio components with after-market accessories, Hearns Hobbies cannot be held responsible for problems or equipment failure caused by incompatibility or modifications. This includes all other products sold by Hearns Hobbies.

GENERAL ERRORS:

Hearns Hobbies makes every effort to ensure the accuracy of the information published here and on our Web site. However, the documents and graphics published on this site may contain technical inaccuracies or typographical errors. Hearns Hobbies makes no representations about the suitability of the information and graphics presented on this site. All such documents and graphics are provided "as is" without warranty of any kind.

PRICING ERRORS:

If an error is made and a product is listed at an incorrect price, Hearns Hobbies shall maintain the right to refuse or cancel any orders placed at the incorrect price. If the order has been confirmed and charged to you, Hearns Hobbies shall immediately issue a credit in the amount of the incorrect price.

AUSTRALIAN CONSUMER LAW OUTLINE:

All goods sold in Australia come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. PAYMENT METHODS:

Hearns Hobbies makes use of various payment methods that are readily available to all customers. As such each payment method has its own TOS, Privacy Policy and T’s & C’s, we advise you appraise yourself of the payment method of your choice before proceeding if you are unsure.

Consumer guarantees cannot be excluded and are in addition to any extended warranty you purchase or any voluntary warranty (warranty against defects) you are given. There may be circumstances where you are not entitled to a remedy.
